2026 DIRTCAR RACING MEMBERSHIP & COMPETITION LICENSE INDEMNITY/RELEASE
(must be completed by all applicants)

THIS MUST BE CAREFULLY READ AND SIGNED. IN CONSIDERATION of being permitted to participate and/or compete in any way in the DIRTcar RACING series race, or other motorsports-related activity or event (“Events”), sanctioned and operated by DIRTcar RACING (“DIRTcar”), I agree, on behalf of myself and my “Affiliates” (as defined below) as follows:

1. Rules and Regulations. I acknowledge, represent, and warrant that I have read and am in compliance with this Applicant Release Agreement (this “Agreement”). I agree to abide by all rules and regulations as set forth by DIRTcar (“Rules and Regulations”), including without limitation the Rules and Regulations relating to car specifications and safety rules (all of which are incorporated herein by reference).

2. Grant of Rights. For good and valuable consideration, the receipt and sufficient of which is hereby acknowledged, I hereby irrevocably grant to DIRTcar and its Affiliates, including, without limitation Event sponsors, advertisers, and marketing partners, the non-exclusive, worldwide, royalty-free and perpetual right and authority to use my name, nickname, initials, image and likeness (in or out of uniform), persona, autograph/signature (including facsimiles thereof), voice, biographical information, career statistics, trademarks, copyrights and/or any and all other intellectual property and/or identifying characteristics relating to me and my racing career (including without limitation the image and likeness of my race vehicle), including without limitation drawings, artistic renderings, photographs, images, audio and/or video of me and/or my race vehicle, in any and all mediums and/or formats (including without limitation print, broadcasts through television, cable television, radio, pay-per-view, closed circuit television, satellite signal, digital signal, film productions, audiotape productions, transmissions over the Internet, public and private online services authorized by DIRTcar, and sales and other commercial projects and the like) for promoting, advertising, or reporting any Event(s), or related telecast or programming, before, during and after such Event(s), and for the publicity, promotion and advertising of the Affiliates. I agree not to take any action, nor cause others to take any action, nor enter into any third-party agreement which would contravene, diminish, encroach or infringe upon the rights granted herein.

3. Ownership. I acknowledge and agree that DIRTcar exclusively and in perpetuity owns any and all rights to broadcast, transmit, film, tape, capture, overhear, photograph, collect or record by any means, process, medium or device (including but not limited to television, cable television, radio, pay-per-view, closed circuit television, satellite signal, digital signal, film productions, audiotape productions, transmissions over the Internet, public and private online services authorized by DIRTcar, sales and other commercial projects, and the like), whether or not currently in existence, all images, sounds and data (including but not limited to electronic transmissions between cars and crews, and timing and scoring information) arising from or during any Event(s) and that DIRTcar is and shall be the sole owner of any and all intellectual property rights (including, but not limited to, patents, copyrights, trademarks, design rights, and other proprietary rights) worldwide in and to these works and in and to any other works, copyrightable or otherwise created from the images, sounds and data arising from, during or in connection with any Event. In addition to the extent not already owned by DIRTcar, I hereby assign to DIRTcar exclusively and in perpetuity any and all rights set forth above. I represent and warrant that as of the date of this Agreement, I have not granted to any third party the rights described herein. I agree to take all steps reasonably necessary, and all steps requested by DIRTcar, to protect, perfect or effectuate DIRTcar’s ownership or other interest in these rights. I agree not to take any action, nor cause others to take any action, nor enter into any third party agreement which would contravene, diminish, encroach or infringe upon these DIRTcar rights. I agree to allow any and all equipment relating to such audio, video, radio, electronic transmissions and timing and scoring information, including, but not limited to, size, location, weight, and use thereof as determined by DIRTcar, in the racing vehicle for each Event.

4. Rules/Participation. I hereby acknowledge receipt of the Rules and Regulations and have fully read and understand them and agree to be bound by and fully abide by the terms and conditions thereof (as they may be changed, modified, or amended by DIRTcar in its sole discretion from time to time). I agree and understand (i) by submitting my race car for various technical and safety inspections, I certify that the race car meets all Rules and Regulations for participation in the Events, (ii) the burden of proof will rest upon me to show that I am in compliance with all of the Rules and Regulations, and (iii) any violation of such Rules and Regulations may result in confiscation of illegal parts, fines, suspension, loss of points, and/or such other penalties as may be deemed appropriate by DIRTcar in its sole discretion. I acknowledge and agree that DIRTcar is the sanctioning body of the Events, and has sole authority to enforce the Rules and Regulations for purposes of exercising its sanctioning authority over all aspects of on-track racing activity during the competition of any Events, including with respect to qualifications and eligibility to race in any Event, inspection process (pre and post-race), race procedures and on track competition, it being understood and agreed that the implementation and enforcement by DIRTcar of the Rules and Regulations may have an adverse impact (including an adverse economic impact) on me. I further agree that all decisions of DIRTcar race officials, or track officials, regarding the interpretation and application of the Rules and Regulations, including without limitation the scoring of positions and other race day decisions, shall be non-litigable. Any disputes regarding the interpretation and application of the Rules and Regulations shall be fully and finally adjudicated by an independent “Appellate Board” created by DIRTcar. The members of the Appellate Board will consist of a mix of DIRTcar representatives, promoters, track operators, team owners, drivers, and/or crew members, as determined by DIRTcar, and such Appellate Board will be subject to the DIRTcar appeals process outlined in the Rules and Regulations. I further covenant and agree that I shall not, directly or indirectly, on behalf of myself or third parties, sue or otherwise initiate any type of legal action against DIRTcar and/or its Affiliates (collectively the “Releasees”) to challenge such decisions, to seek monetary damages, to seek injunctive relief or other equitable relief, or to seek any other type of legal remedy. I agree that my sole and exclusive remedy against a Rules and Regulations decision I disagree with is for me to pursue an appeal of the decision with the Appellate Board as set forth by the Rules and Regulations. I understand that if I sue or otherwise pursue or initiate any such legal action, which expressly violates this provision, then (i) I expressly agree to and shall reimburse the Releasees for all of their attorneys’ fees and costs in defending against such legal action, and (ii) any suspension I am under at the commencement of such legal action will be extended for the length of time such legal action was in violation of this provision, such extended suspension time to begin after such legal action has been fully dismissed.

5. Integrity. I recognize the detriment to DIRTcar and professional racing that would result from the impairment of public confidence in the honest and orderly conduct of DIRTcar Events or the integrity and good character of DIRTcar members. During my participation, I agree to conduct myself at all times, in all material respect, with due regard to public morals and conventions, and agree that I will not commit any, act or do anything that is or shall be a material offense, involving moral turpitude or the violation of DIRTcar Rules and Regulations. Furthermore, I shall not directly or indirectly accept a bribe and/or agree to throw or fix the Events, nor shall I directly or indirectly bet or otherwise gamble on the Events. In the event I become aware of a bribe, offer or attempt to throw or fix the Events, I shall promptly report same to DIRTcar.

6. Publicity. I understand that any appearance that I may make in connection with the Events is strictly for the purpose of participating in the Events. I understand and agree that all publicity in connection with the Events is under the sole control of DIRTcar, and any television station or channel, cable network, or satellite network that airs the Event. I further agree to consult with DIRTcar regarding any and all publicity in connection with my involvement and/or appearance in the Events and shall not consent to any publicity without the prior approval of DIRTcar. Except as specifically provided herein, or as otherwise authorized by DIRTcar, I will not myself, or authorize others to, at any time, publicize, advertise, or promote my appearance in the Event, receive, or generate any monetary advantage from my appearance in the Events, or use or disclose to any third party any confidential business information or trade secrets obtained or learned as a result of my participation in the Events.

7. Confidentiality. I hereby acknowledge and agree that the subject matter of this Agreement is confidential, and I agree that I shall not make any statement or engage in communications of any kind with any third party, regarding this Agreement or the Events, nor the outcome of the Events in connection herewith, prior to their airing and/or DIRTcar’s disclosure of same. My confidentiality obligations under this Agreement shall survive the termination or expiration of this Agreement. Without limiting the foregoing in any way, I will not myself, nor authorize others to, prepare or assist in the preparation of any written work, any audio work, and/or any visual work that depicts, concerns, and/or relates in any way to my appearance at the Event. Neither I, nor anyone acting on my behalf, shall at any time use any of DIRTcar or its Affiliate’s name(s), logo(s), trade name(s), and/or trademark(s) (including, but not limited to, the title of the Events) for any purpose or in any manner whatsoever. I recognize that a breach by me of this paragraph would cause DIRTcar irrevocable injury and damage that cannot be reasonably or adequately compensated by damages in an action at law, and therefore, I hereby expressly agree that DIRTcar shall be entitled to injunctive and other equitable relief, without posting any bond, to prevent and/or cure any breach or threatened breach of this paragraph by me.

8. Equitable Relief. I acknowledge that my breach or threatened breach of this Agreement may result in immediate and irreparable damage to DIRTcar and/or its Affiliates and that monetary damages will be inadequate to compensate DIRTcar. Therefore, in the event of a material breach or threatened material breach of this Agreement by me, DIRTcar may, in addition to other remedies, immediately seek to obtain and enforce injunctive relief prohibiting the material breach or threatened material breach or compel specific performance. In the event of a breach or threatened breach of this Agreement by DIRTcar, I hereby expressly recognize that the damage, if any, caused to me thereby, would not be irreparable or otherwise sufficient as to give rise to a right of injunctive or other equitable relief, and I acknowledge that my rights and remedies in the event of a breach of this Agreement by ACL will be limited to the right, if any, to receive monetary damages in any action at law. For the avoidance of doubt, in no event shall I be permitted to stop, interfere with, enjoin, or otherwise impact DIRTcar’s ability to conduct and/or distribute its events and/or competitions, including the Events hereunder, or any subsidiary or allied rights with respect thereto.

9. Release of Liability/Assumption of Risk. THE UNDERSIGNED HEREBY ACKNOWLEDGES AND AGREES THAT THE EVENTS (INCLUDING WITHOUT LIMITATION TRAVEL TO AND FROM THE EVENTS) ARE INHERENTLY AND ABNORMALLY DANGEROUS ACTIVITIES WHICH CARRY WITH THEM SIGNIFICANT RISK OF SEVERE AND PERMANENT PERSONAL INJURY, BODILY INJURY, MEDICAL PROBLEMS, INCLUDING THOSE THAT MAY DEVELOP MANY MONTHS OR YEARS LATER, EMOTIONAL DISTRESS, MENTAL OR PHYSICAL ILLNESS, DANGERS ASSOCIATED WITH PARTICIPATING IN THE EVENTS DURING THE COVID-19 PANDEMIC (E.G. CONTRACTING COVID-19 OR OTHER RELATED DISEASES OR HEALTH COMPLICATION SUCH AS THE FLU, PNEUMONIA, ACUTE RESPIRATORY FAILURE, KIDNEY FAILURE, LIVER FAILURE OR CARDIAC DISTRESS), LOSS OF CONSORTIUM, PROPERTY DAMAGE OR LOSS, IRREVERSIBLE NEUROLOGICAL TRAUMA, DISABILITY, AND/OR DEATH. I ALSO UNDERSTAND THAT THERE ARE NATURAL, MECHANICAL, AND ENVIRONMENTAL CONDITIONS AND RISKS, WHICH INDEPENDENTLY OR IN COMBINATION WITH SUCH ACTIVITIES, MAY CAUSE PROPERTY DAMAGES OR SEVERE OR EVEN FATAL INJURIES TO ME OR OTHERS. I, WITH FULL KNOWLEDGE OF AND HAVING EVALUATED SUCH RISKS, NONETHELESS HAVE MADE A VOLUNTARY CHOICE TO PARTICIPATE IN SUCH EVENTS AND TO ENTER INTO THIS AGREEMENT. I AGREE TO ACCEPT ALL RESPONSIBILITY FOR THE INHERENT AND EXTRAORDINARY RISKS, CONDITIONS AND HAZARDS WHICH MAY OCCUR WHETHER OR NOT THEY ARE KNOWN OR CONTEMPLATED BY ME. I HEREBY EXPRESSLY ASSUME ALL SUCH RISK AND ACCEPT SOLE RESPONSIBILITY FOR THE SAFETY AND MEDICAL INSURANCE COSTS IN CONNECTION THEREWITH. I, ON BEHALF OF MYSELF AND MY AFFILIATES, HEREBY VOLUNTARILY CONSENT TO FOREVER AND IRREVOCABLY WAIVE, RELEASE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS THE RELEASEES FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, RIGHTS OF ACTION, SUITS, COSTS, LIABILITIES, JUDGMENTS, OBLIGATIONS, LOSSES, INJURIES, PENALTIES, EXPENSES AND/OR DAMAGES (INCLUDING, WITHOUT LIMITATION, LEGAL FEES AND EXPENSES) OF WHATSOEVER KIND OR NATURE (“CLAIMS”) IMPOSED ON, INCURRED BY OR ASSERTED AGAINST ANY OF THE RELEASEES BY ME AND/OR ANY DRIVER AFFILIATE, ARISING DIRECTLY OR INDIRECTLY FROM, OR IN ANY WAY RELATED TO, MY PREPARATION FOR, TRAVEL FOR, AND PARTICIPATION IN AND APPEARANCE IN ANY EVENT(S) OR AS OTHERWISE RELATED TO THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY AND ALL CLAIMS RELATING TO INJURY, ILLNESS, DAMAGE, LOSS, OR HARM TO MYSELF OR MY PROPERTY, OR MY DEATH OR DISABILITY, HOWSOEVER CAUSED, RESULTING FROM OR ARISING OUT OF OR IN CONNECTION WITH MY PREPARATION FOR, TRAVEL FOR, PARTICIPATION IN AND APPEARANCE IN ANY EVENT(S), INCLUDING WITHOUT LIMITATION RELATING TO ACTS, OMISSIONS AND/OR NEGLIGENCE (INCLUDING WITHOUT LIMITATION GROSS NEGLIGENCE AND/OR NEGLIGENT CONDITIONS).

10. Miscellaneous. No waiver of any term or right in this Agreement shall be effective unless in writing, signed by an authorized representative of the waiving party. The failure of any party to enforce any provision of this Agreement shall not be construed as a waiver or modification of such provision, or impairment of its right to enforce such provision or any other provision of this Agreement thereafter. I understand that I am neither an agent nor employee nor independent contractor of any of the Releasees. Further, I understand that I am solely responsible for compensating my employees, independent contractors, agents and pit crew members. I also assume full responsibility for reporting or filing any reports or tax returns with the appropriate authorities on any and all earnings or funds received as a result of my participation in Events, including, but not limited to, Federal Social Security taxes, Federal income taxes, State income taxes, Federal and State withholding taxes, unemployment taxes, and all applicable labor and other requirements with respect to my self-employment, sole proprietorship, or other form of business organization, and workers compensation insurance. I agree to indemnify, defend, and hold the Releasees harmless from any liability for, or assessment of, any claims or penalties, including attorneys’ fees and costs incurred, with respect to any tax liability, including labor or employment taxes, imposed on the Releasees by the relevant taxing authorities with respect to any compensation paid to me by DIRTcar. I acknowledge and understand that the Releasees abide by all applicable federal, state and local guidelines and orders relating to the Events, including without limitation preventative measures put in place to reduce the spread of COVID-19; however, the Releasees cannot and will not guarantee that any persons present/in attendance at the Events will not become exposed to or infected with COVID-19 or any other communicable disease or illness, some of which may carry a risk of suffering severe personal injury and/or death, despite reasonable efforts to mitigate such dangers. I hereby release, waive, discharge and covenant not to sue the Releasees from all liability to me, including without limitation my personal representatives, assigns, heirs, and next of kin, for any and all loss or damage, and any claim or demands therefor on account of my contraction of any communicable illness or disease, including without limitation COVID-19, arising out of or in any way related to my participation in and/or presence at the Events, whether caused by the negligence of the Releasees or otherwise. Any provision of this Agreement providing for performance by either party after termination of this Agreement shall survive such termination and shall continue to be effective and enforceable. In the performance of the terms of this Agreement the parties shall comply with all applicable federal, state, regional and local laws, rules and regulations. If any provision or portion of this Agreement shall be held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining provisions or portions shall remain in full force and effect.

BY SIGNING THIS AGREEMENT, I VERIFY THAT (I) I AM IN GOOD HEALTH AND HAVE NO CONDITIONS THAT WOULD IMPACT MY PARTICIPATION IN THE EVENTS; (II) NO ORAL OR THIRD PARTY REPRESENTATIONS, STATEMENTS OR INDUCEMENTS HAVE BEEN MADE BY DIRTCAR OR ITS AFFILIATES; AND (III) ALL OF THE INFORMATION I HAVE PROVIDED AND/OR ATTESTED TO IN THIS AGREEMENT IS TRUE AND ACCURATE. DEFINED TERMS USED HEREIN BUT NOT DEFINED SHALL HAVE THE MEANING SET FORTH IN DIRTCAR’S RULES AND REGULATIONS HANDBOOK.

SUBSTANCE ABUSE POLICY TERMS AND CONDITIONS

PURPOSE.

The World Racing Group (hereinafter "WRG") is dedicated and committed to making its racing series safe for both competitor and spectators. WRG understands that misuse and abuse of alcohol and drugs, both legal and illegal, is a serious threat to the safety and security of motorsports, and by way of this policy, it seeks to control and eliminate such misuse and abuse at or in connection with its events. WRG requires the cooperation and assistance of all of its competitors and members in effectively implementing the "World Racing Group Substance Abuse Policy" (hereinafter "Policy"). All members, drivers, mechanics, crew members, officials, workers, and others participating in WRG events in any way (hereinafter collectively "Participants") agree to be bound by, and to comply with, the Policy terms and conditions at all WRG events at all times.
PROHIBITIONS.
1. Prohibited Substances.
  
  Pursuant to this Policy, prohibited substances include those substances that, in WRG’s sole determination, may adversely affect the safety and well-being of the Participants or the competition at a WRG event. Such substances include, but are not limited to, illegal drugs and the paraphernalia associated with the use of illegal drugs. WRG reserves the right, in its sole discretion, to make a determination with regard to the prohibition of any substance at any time. Pursuant to this Policy, said discretion includes the ability of WRG to make the determination after it receives the results of a drug test pursuant to this Policy. Participants shall not use, possess, purchase, sell, manufacture or participate in the distribution of prohibited substances, in any amount and at any time.
2. Prescriptions and Over-the-Counter Medications.
  
  Participants shall use prescription and over-the-counter medications responsibly, and Participants should be fully informed as to the medications’ potential impact and effect on participation at WRG events. Participants should not use prescription or over-the-counter medications during WRG event if such use impairs or diminishes their skills or abilities, or if it affects the Participants’ safety or the safety of others. Even when properly used, prescription and over-the-counter medications can be dangerous and result in an unsafe environment, particularly during high speed motorsports activities.
  
  Misuse of a prescription or over-the-counter medication by Participants, including, without limitation, use that is inconsistent with the instructions provided by the manufacturer, pharmacist, and/or the prescribing physician, is strictly forbidden. WRG reserves the right and ability to prohibit the use or misuse of any particular prescription or over-the-counter medication, and to deem such use or misuse detrimental to the safety of Participants, the sport, and/or others. Any medication that causes Participants to have a diminished or impaired ability to perform his or her duties at and WRG event shall be deemed to be prohibited for the purpose of this Policy. The illegal acquisition and/or distribution of any prescription or over-the-counter medication is also strictly prohibited.
3. Alcohol.
  
  On event days, Participants in WRG events are strictly prohibited from consuming or being under the influence of alcohol prior to or during the event. Participants shall be deemed under the influence of alcohol if a test taken before, during, or immediately after participation (in any capacity) indicates a blood alcohol content level at or above 20 mg per 100ml (.02%). However, nothing in the terms and conditions of this Policy shall prevent WRG from exercising its sole discretion to determine that a Participant evidencing alcohol usage in any amount (even with a blood alcohol content level of below 20mg per 100ml [.02%]) is under the influence and/or physically unfit for participating in the event. WRG reserves the right and ability to take such action in the interest of safety and in the best interest of the sport.
TESTING BASED UPON REASONABLE SUSPICION.

WRG can require a Participant to submit to a test or tests for the presence of alcohol, drugs or medications if a WRG event or sanctioning body official has reasonable suspicion that the Participant has violated any part of this Policy or has impaired or diminished abilities to perform as a result of using a prohibited substance. Pursuant to this Policy, testing may be performed using breath, urine, saliva, and/or blood. WRG also reserves the right and ability to determine that Participants are under the influence of alcohol, drugs, or medications through the use of a physical field test checking physical impairments or diminished capacities.

Circumstances and factors that may cause WRG to have reasonable suspicion include, without limitation the following:
1. Illegal substances or illegal drug paraphernalia is observed in the possession of the Participant at any time;
2. The Participant is observed exhibiting one or more of the following symptoms or behaviors, which can potentially be associated with the use of alcohol, drugs, and/or medications:
  1. Physical signs of red or droopy eyes, and/or dilated or constricted pupils;
  2. Slurred speech, stumbling, or hyperactivity;
  3. Needle marks present on the Participant’s body;
  4. Repeated unexplained disappearances from an event;
  5. A constantly running or sniffling nose, or a nose that appears consistently red or irritated;
  6. The inability to understand or track time, exhibited, for example, by the Participant being regularly tardy or absent from appointments or commitments;
  7. Chronic forgetfulness or broken promise;
  8. An abnormal number of accident during events;
  9. Involvement in conduct which violates WRG safety procedures or involvement in careless acts during a WRG event;
  10. Inability to concentrate, lack of recollection, and/or lack of attention;
  11. Mental confusion, paranoia, or the presence of abnormal or unreasonable thoughts and ideas;
  12. Exhibitions of violent tendencies, loss of temper, irritability, or unreasonably aggressive behavior;
  13. Statements by a Participant that may indicate that he or she uses prohibited substances;
  14. Extreme personality changes and/or mood swings;
  15. Noticeably declining personal hygiene and appearance;
  16. A pattern of abnormal conduct;
  17. Violation of WRG rules or a failure to follow safe practices; and
  18. Evidence of attempts to falsify, alter or modify prior alcohol or drugs tests.
3. The Participant is charged with, suspected of, or arrested or convicted for driving while under the influence of alcohol, drugs, medications, or other prohibited substances;
4. The Participants is charged with, suspected of, or arrested or convicted for any type of drug related offense;
5. The WRG receives information from a reliable source that the Participant is under the influence of alcohol, drugs, medications, or other prohibited substances on the day of a WRG event, or that the Participant is using, possessing, distributing, or selling illegal drugs or other prohibited substances at any time.
6. The smell of alcohol or other prohibited substance is evident on the person of any Participant on the day of any WRG event.
7. The results of an examination or test administered by, or at the request of WRG, indicates evidence that the Participant is or was using a prohibited or illegal substance, or the Participants is abusing alcohol;
8. The Participant attempts to alter or manipulate a specimen used in connected with testing under this Policy, or the Participant attempts to alter or manipulate the results of any such testing or examination.
RANDOM TESTING.

Participants understand and acknowledge that WRG reserves the right and ability to implement (in its sole discretion) a random and/or annual testing procedure and require Participants to submit to such testing. The selection of Participants to submit to random or annual testing shall be made by WRG in WRG’s sole discretion.
AUTHORIZATION FOR TESTING; WAIVER AND RELEASE; COMPLIANCE.

If a WRG Participant refuses to sign, execute, and/or deliver an authorization for testing in connection with this Policy, and/or the "WRG Substance Abuse Policy Waiver and Release, Express Assumption of the Risk, and Indemnity Agreement" prior to participation in WRG events as required by WRG, the Participant will not be issued membership in, or a license to, WRG, and the Participant will not be permitted to participate in WRG events. In such a circumstance, if a Participant is already a member, and/or already has a WRG license, the Participant will be suspended until he or she complies with all requirements of this Policy.

Upon request pursuant to this Policy, Participants must comply and submit to testing within the time period designated by the WRG officials. If a Participant refuses to comply with or participate in testing within the time period designated by WRG officials, the Participant may be removed from WRG event premises and suspended from competition. In such a circumstance, the Participant will also be subject to additional disciplinary action pursuant to this Policy.
TESTING PROCEDURES.
1. Handling of Specimens
  
  WRG shall designate certain WRG officials with the responsibility to collect test specimens and to carry out the following procedures with due care and diligence:
  1. To ensure that the specimens are properly designated and are accurately logged and registered from Participants. This may include the observing the specimen collection process.
  2. To ensure that the specimens are collected within the appropriate and designated time periods. According to this Policy, specimen collections should normally be made within one hour or less of the Participant being notified that testing will be conducted. However, WRG reserves the right to designate a different time period as circumstances require or warrant.
  3. To ensure that the specimens are not altered or manipulated, including by promptly measuring the temperature of the specimens. WRG may, in its sole discretion deem any particular sample inappropriate for testing and require a Participant to provide additional specimens, as necessary.
  4. To label, secure, and transport the specimens to WRG’s designated testing facility in such a manner as to ensure the integrity of the specimens.
  5. To obtain forms completed by the Participants in connection with testing, identifying all prescription and over-the-counter medications consumed by the Participant in the preceding three months.
2. Testing Facility.
  All testing pursuant to this Policy will be completed at a facility (or facilities) selected by WRG, in its sole discretion, from the listing of those facilities that have been certified by the Substance Abuse and Mental Health Services Administration of the United States Department of Health and Human Services and/or by the College of American Pathologists Forensic Urine Drug Testing Program (hereinafter the "Facility").
3. Testing Specifics.
  The Facility shall determine the appropriate standards and methods of analysis regarding specimens submitted concerning WRG Participants. The Facility shall also determine if, and to what extent, a specimen is deemed to be a true positive for a prohibited substance and/or alcohol, along with whether or not the specimen has been altered or manipulated. The Facility shall transmit all testing results to an official (or officials) designated by WRG for interpretation, and for determination of the appropriate course of action.
POSITIVE TESTS
1. Concerning Prohibited Substances Other Than Alcohol:
  1. Upon being notified by the designated WRG official (or officials) of a true positive test result for a WRG Participant, the WRG Officials shall suspend the Participants’ membership and license with WRG for an indefinite period, and it shall take such other disciplinary action it deems appropriate under the circumstances pursuant to this Policy and WRG rules and guidelines.
  2. If, following a suspension (and the enforcement of any other disciplinary action), a Participant desires to resume participation in any way in a WRG event, the Participant must obtain approval from the WRG Appeals Board and/or WRG Supervisory Officials and must voluntarily submit himself or herself to follow up, and regularly scheduled, testing as deemed necessary by the WRG Supervisory Officials and/or Board. Such follow up testing shall be conducted in a manner, and under certain conditions, as determined necessary by the WRG Supervisory Officials and/or Board. The follow up testing as determined by the WRG Supervisory Officials and/or Board shall also be conducted solely at the expense of the Participant. In the event that a suspended Participant submits to follow up testing and such testing shows no evidence of a prohibited substance, the WRG Supervisory Officials and/or Board may reinstate the Participant, assuming the Participant is otherwise eligible to participate, and assuming that the Participant agrees to make himself or herself available for future random tests without the need for reasonable suspicion. Such random testing shall be conducted as the WRG Supervisory Officials and/or Board sees fit, shall take place at any time and at any WRG event, and shall be conducted at Participant’s sole expense.
2. Concerning Alcohol:
  1. Upon being notified by the designated WRG official (or officials) that a Participant has consumed alcohol in violation of this Policy, the WRG Supervisory Officials and/or Appeals Board may suspend the Participant’s membership and/or license for an indefinite period and/or take such other disciplinary action deemed appropriate under the circumstances.
  2. If, following a suspension (and the enforcement of any other disciplinary action), a Participant desires to resume participation in any way in a WRG event, the Participant must obtain approval from the WRG Appeals Board and/or Supervisory Officials and must voluntarily submit himself or herself to follow up, and regularly scheduled, testing as deemed necessary by the Board. In the event that a suspended Participant submits to follow up testing and such testing shows no evidence of alcohol or a prohibited substance, the WRG Supervisory Officials and/or the Board may reinstate the Participant, assuming the Participant is otherwise eligible to participate, and assuming that the Participant agrees to make himself or herself available for future random tests without the need for reasonable suspicion. Such random testing shall be conducted as the WRG Supervisory Officials and/or Board sees fit, shall take place at any time and at any WRG event, and shall be conducted at Participant’s sole expense.
3. Publication:
  
  Participants agree that WRG may, as it deems reasonable under the circumstances, publish the results of any test or tests conducted pursuant to this Policy and the circumstances giving rise to such test to such third parties. Participants also agree that WRG may, in its discretion, publish information regarding disciplinary action taken as a result of any testing or any violation of the Policy. Participants shall have no claim or cause of action of any kind against WRG or any of its officials, directors, officers, employees or agents with respect to any such publication.
COMPROMISED TESTS.

A Participant who acts with the intent, and/or does in fact, falsify, alter, or otherwise manipulated with any specimen or any aspect of the testing procedure or process under this Policy will be subject to disciplinary action as issued by the WRG Supervisory Officials and/or WRG Appeals Board. A specimen that is identified as having been falsified, altered, or manipulated shall be treated in the same manner as a true positive test result for a prohibited substance other than alcohol, with all attendant consequences and results as set forth above.
PROHIBITED ACTED UNDER THIS POLICY.

If WRG determines that a Participant has engaged in any prohibited act under this Policy or has acted in a manner contrary to the purpose and intent of this Policy, WRG may remove the Participant from the WRG event premises and/or take any other emergency action as is deemed appropriate under the circumstances. In such a circumstance, the Participant will also be subject to disciplinary action as issued in the discretion of the WRG Supervisory Officials and/or WRG Appeals Board.
TREATMENT FOR ALCOHOL, DRUGS, OR MEDICATIONS.

WRG shall not be involved in recommending or prescribing any particular rehabilitation programs or procedures in response to a violation of this Policy. However, WRG strongly encourages Participants in violation of the Policy to obtain professional and ongoing help and assistance. In determining potential reinstatement and future participation, WRG will take into account a Participant’s efforts to obtain professional help, and it will consider the results and successful completion of programs and assistance.
WRG RULES.

This Policy, as it may be amended from time to time, serves as a supplement to the currently effective WRG Rules as promulgated by the WRG Supervisory Officials and/or WRG Board of Directors. This Policy shall be interpreted and applied by the WRG in the context of and in connection with the WRG Rules. This Policy is, and shall be, binding upon all WRG members in the same manner, and to the same extent, as the WRG Rules.

WORLD RACING GROUP SUBSTANCE ABUSE POLICY AUTHORIZATION FOR TESTING OF ALCOHOL, DRUGS, MEDICATIONS, AND OTHER PROHIBITED SUBSTANCES; AND WAIVER AND RELEASE, EXPRESS ASSUMPTION OF THE RISK, AND INDEMNITY AGREEMENT

IN FULL AND COMPLETE CONSIDERATION OF the World Racing Group ("WRG") allowing me to become a member of WRG and/or IN CONSIDERATION of WRG issuing me a license to participate and/or IN CONSIDERATION of WRG allowing me to participant in an way in WRG events and activities, and/or IN CONSIDERATION OF me being able to enter into or upon the premises and facilities and locations where said EVENTS are or will be taking place , I, on behalf of my personal representatives, heirs, and next of kin (hereinafter collectively "PARTICIPANT") hereby acknowledge and agree as follows:
PARTICIPANT hereby GIVES HIS CONSENT TO WRG (and its designated agents and officials) to collect blood, urine, saliva, hair, and breath specimens from me; and to test those specimens for the presence of alcohol, drugs, medications, and/or any prohibited substances under WRG’s Substance Abuse Policy ("Policy"); and to conduct such other test (including physical field tests checking physical impairments or diminished capacities) as deemed necessary by WRG from time to time to determine whether or not PARTICIPANT’s ability to participate in any way at any WRG event may be diminished or impaired as set forth in the Policy. PARTICPANT has received, read and understand the Policy dated March 2008, and PARTICIPANT understands and acknowledges that the Policy may be amended by WRG from time to time. PARTICIPANT is responsible to become aware of and remain familiar with the terms and conditions Policy at all times, including with regard to any revisions thereto. PARTICIPANT recognizes and accepts that the Policy has been implemented and administered by WRG to promote both the integrity of WRG events and the safety of those participating in and present at WRG events.
PARTICIPANT hereby RELEASES, DISCHARGES, AND COVENANTS NOT TO SUE WRG, track owners, operators, lessors, or lessees, event promoters and sponsors, and all of their officials, officers, employees, directors, agents, and any individuals or facilities affiliated with testing performed pursuant to the Policy (collectively "RELEASEES") FROM ALL LIABILITY OF WHATEVER KIND OR NATURE, IN LAW, EQUITY OR OTHERWISE, WHETHER NOW KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, FOR ANY AND ALL PRESENT OR FUTURE LOSS OR DAMAGE, AND ANY CLAIMS, LIENS, DEMANDS, CAUSES OF ACTION, debts, liabilities, expenses including court costs and attorneys fees, SUITS OR JUDGMENTS THEREFROM (collectively "LIABILITY") ON ACCOUNT OF ANY PERSONAL INJURY, INJURY TO PERSONAL PROPERTY, OR RESULTING IN DEATH ARISING OUT OF OR RELATED TO any acts or omissions concerning the development, implementation, or enforcement of the Policy, the selection or retention of any person or entity in connection with the Policy, and/or the publication of information concerning the Policy, including, without limitation test results or disciplinary action taken. This specifically includes, without limitation, LIABILITY arising from the ordinary negligence of RELEASEES.
PARTICIPANT also acknowledges and understands that testing pursuant to the Policy and WRG events can be VERY DANGEROUS and could result in PERSONAL INJURY, DEATH, and/or PROPERTY DAMAGE. Participation in the Policy and WRG events can result in serious physical, mental, or emotional stress and strain, disability, and/or disfigurement. This agreement also constitutes an express and contractual ASSUMPTION OF ALL RISKS AND DANGERS associated with the Policy and WRG events, including the potential ordinary NEGLIGENCE of the RELEASEES. PARTICIPANT understands that RELEASEES make no warranties or representations about the Policy or testing procedures, equipment, services, or facilities.
PARTICIPANT further hereby agrees to DEFEND, INDEMNIFY, SAVE AND HOLD HARMLESS the RELEASEES from any LIABILITY (including from court costs and attorneys fees) arising out of or related to this agreement, the Policy, or PARTICIPANT’s participation in WRG events.
PARTICIPANT agrees and understands that this agreement shall be deemed entered into in Mecklenburg County, North Carolina, and that it shall be governed by and interpreted under the laws of North Carolina. This agreement is intended to operate and be construed as broadly as allowed under North Carolina law.
PARTICIPANT agrees and understands that this agreement is intended to be fully severable and that if any portion of this agreement is found to be void or invalid, the remainder of the agreement shall be enforced to the fullest extent of the law. 1
PARTICIPANT HAS READ THIS AGREEMENT, FULLY UNDERSTANDS ITS TERMS, AND UNDERSTANDS THAT THIS IS AN IMPORTANT LEGAL DOCUMENT. PARTICIPANT FURTHER UNDERSTANDS THAT BY SINGING THE AGREEMENT HE IS GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHTS OF HIS FAMILY. PARTICIPANT SIGNS THIS DOCUMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO HIM, AND HE INTEND HIS SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. PARTICIPANT further agrees that no oral representations, statements or inducements, apart from the foregoing written agreement, have been made to him. He was given ample opportunity to read the agreement and/or have it reviewed by legal counsel of his choice. He was also offered a copy of this agreement.

Gambling Policy

All race personnel, including but not limited to, drivers, team personnel, crew, officials and staff (“Personnel”), are strictly prohibited from placing, soliciting or facilitating any bet or wager, whether directly or through a third-party proxy or surrogate on any class of a World Racing Group (WRG) event if: (i) they compete in any class of the same event, (ii) have a direct or indirect association or affiliation with the event (such as promotor, track owner or track employee), or (iii) they are aware of information regarding an event or its competitors that would give them an advantage in placing a wager. This applies to all events sanctioned or operated by subsidiaries or affiliates of WRG. All WRG staff are prohibited from placing any wager on any WRG event.

This prohibition applies to all Personnel, and includes but is not limited to, betting or wagering on season, race, or event outcomes, statistics, scores, individual performances and any other kinds of bets and wagers. In addition, all Personnel are explicitly prohibited from providing “tips” or non-public information to third parties. This includes direct or indirect disclosure or suggestion of any information that the individual had access to as a result of their position in the racing industry or other non-public knowledge or information, that is used for the purpose of wagering would provide an unfair advantage.

WRG will maintain a zero-tolerance gambling policy and WRG reserves the right to pursue legal or disciplinary action regarding violations of this policy. All Personnel are obligated to report any actual or suspected violations of this policy without delay, and without the need to be prompted or questioned on the matter. Violations of the WRG gambling policy will result in disciplinary action, including but not limited to, fines, suspension, membership revocation, race or event forfeiture or disqualification and/or loss of points, and/or prohibition from WRG sanctioned events and properties where WRG events take place.
